COUNCIL TRIPPED

A pedestrian tripped and fell on a concrete ramp leading
to a footpath on which a small section of concrete had
become detached from the ramp. The trial judge found
that the detached piece of concrete had been placed
over a hole in the ramp about two years earlier and
had detached because of poor workmanship. The trial
judge also accepted the pedestrian’s evidence
that she had not noticed the defect before her fall,
notwithstanding that she lived very close to the ramp
and was very familiar with the footpath where she fell.
